As general counsel, we take an active view toward litigation and legal disputes. We employ our seasoned expertise to avoid costs where possible, while adding demonstrable value to our clients.
First, we are guided by the primary need to contain our client’s risk and exposure. Our experience as general counsel gives us a unique ability to view all disputes and crises from both cost-benefit and “franchise” perspectives. We provide our clients with reasoned options and strategies based on years of making “go, no-go” decisions with senior management, as part of the executive suite.
We believe this represents a unique attribute of our practice that outside law firm counsel simply cannot match.
We provide our clients with a focused, cost-effective representation in “bet the company” cases, as well as in traditional commercial actions, and we routinely handle matters on behalf of major corporations as well as entrepreneurs, for whom it is especially important that counsel understand how to achieve expeditious and cost-effective resolutions.
We particularly excel in one area, often overlooked by clients (and their outside law firms), which is the pursuit of strategies to obtain insurance coverage for defense and settlement costs whenever possible. We have been successful in obtaining millions of dollars in in defense and settlement costs from major insurers, that our clients would otherwise have had to pay themselves.
If pursued, we believe successful litigation requires a comprehensive, 360-degree strategy that is carefully calibrated to each client’s specific needs, risks and goals — with a view toward the existing political, economic, and social landscape. This includes robust and efficient management of outside litigation counsel, preparation of discovery responses, preparation and selection of witnesses, review of court pleadings, and pre-trial activities.
Our representation also includes ongoing cost-benefit analysis with clients and preparation of spending budgets.
